Becoming Retreats – Terms & Conditions
These Terms and Conditions (“Agreement”) apply to all retreats, workshops, events, and related services organised by Becoming Retreats Ltd (“Becoming Retreats”, “we”, “our”, “us”).
By booking and/or attending a retreat, class, workshop, private session, or event (“Retreat”), you (“Participant”, “you”, “your”) agree to the following terms.

1. Booking and Eligibility
By signing up to a Becoming Retreats event, you confirm that you are 16 years of age or older, in good physical and mental health, and have consulted a qualified medical professional if you have any pre-existing medical conditions, injuries, or concerns. You acknowledge that certain levels of strength, fitness, and flexibility are required for participation. By booking and attending a retreat, class, or event, you agree to the terms of the Becoming Retreats Health and Safety Liability Waiver, which forms part of this agreement and applies automatically upon registration.

2. Services Provided
Becoming Retreats shall provide the Participant with accommodation, daily yoga sessions, breathwork, meals (where included), and other scheduled activities as listed within each retreat’s published itinerary.
Activities may include, but are not limited to, yoga, breathwork, cold water immersion, swimming (pool, sea, or open water), hiking, excursions, meditation, workshops, surfing, and/or boat trips.
Becoming Retreats reserves the right to make reasonable changes to the schedule or content of a retreat at any time.

3. Payment
3.1 Total Cost
The total cost of the Retreat must be paid in full prior to the Retreat, as set forth below. Failure to make payments as required will constitute an automatic breach of this Agreement by the Participant, and all payments made shall be forfeited.
3.2 Non-Refundable Deposit
A non-refundable deposit of £250 is due at the time of booking. This deposit secures your space and becomes non-refundable immediately upon payment.
If your initial payment at checkout is less than £250, the remaining balance of the full deposit will still be due.
3.3 Balance Payment
The remaining balance must be paid no later than 60 days prior to the Retreat start date. Failure to make full payment by this date will result in automatic forfeiture of your booking and the loss of all payments made.
3.4 Discount Codes
The £250 non-refundable deposit applies in all circumstances, regardless of any discount code or promotional offer used. Discounts are applied to the total retreat price, not to the deposit amount. In the event of cancellation, the full £250 deposit remains payable even if your initial payment at checkout was less than this amount.
3.5 Payment Plans
If you choose to pay via a payment plan, you agree to complete all scheduled payments in full, even if the final instalment is due after the retreat start date.
By entering a payment plan, you acknowledge that this constitutes a binding financial commitment to pay the entire retreat cost, regardless of attendance or cancellation. Failure to complete payments as agreed will be treated as a breach of contract, and the outstanding balance will remain legally due and payable to Becoming Retreats.

4. Cancellations
4.1 General Policy
Becoming Retreats reserves the right to make any changes deemed necessary, including retreat cancellation, as per these Terms and Conditions. All cancellation requests by the Participant must be submitted in writing via email to booking@becomingretreats.com.

4.2 Participant Cancellations
The £250 non-refundable deposit and an administration fee of £200 will be retained upon cancellation of this Agreement, regardless of the time or reason for cancellation.
This includes, but is not limited to: travel restrictions, quarantines, medical emergencies, lockdowns, illness, Covid-19, future pandemics or public health events, travel changes, border closures, or natural disasters.
Cancellations received up to and including 61 days prior to the start of the Retreat: any payments made (excluding the non-refundable deposit and £200 administration fee) may be eligible for a partial refund at the discretion of Becoming Retreats.
Cancellations received less than 60 days prior to the start of the Retreat: no refunds will be issued under any circumstances. The full amount paid (or owed under a payment plan) will be retained.
4.3 Non-Attendance and Early Departure
If the Participant fails to attend, arrives late, or leaves the Retreat early for any reason, no refund or credit will be issued.
4.4 Organiser Cancellations
If Becoming Retreats must cancel a retreat due to unforeseen circumstances, you will be offered the choice to transfer to another retreat or receive a credit for a future event. Cash refunds may be offered at the organiser’s discretion. Becoming Retreats is not liable for additional costs incurred (such as flights, transfers, or other expenses).

5. Public Health and Pandemic Clause
Becoming Retreats operates in accordance with public health guidance and government regulations.
In the event of COVID-19 or any future pandemic, epidemic, or similar public health event, you acknowledge and agree that:
Retreats, classes, or events may be postponed, cancelled, or altered due to restrictions beyond the organiser’s control.
You are responsible for complying with any health or travel requirements (including testing, vaccination, or quarantine) imposed by relevant authorities.
Becoming Retreats and its representatives are not liable for illness, injury, travel disruption, or financial loss resulting from such events.
Standard cancellation and refund policies (outlined above) will still apply.

6. Behaviour and Conduct
Participants are expected to behave respectfully towards staff, facilitators, property, and fellow guests. Becoming Retreats reserves the right to remove any participant from a retreat without refund if their behaviour is unsafe, disruptive, or negatively impacts the wellbeing or experience of others.

7. Travel and Insurance
Participants are strongly advised to obtain comprehensive travel insurance covering illness, injury, cancellations, pandemics, and travel disruption. Becoming Retreats accepts no liability for any loss, injury, or damage to person or property that occurs during travel or while attending the retreat.

8. Personal Belongings and Property Damage
Becoming Retreats is not responsible for the loss, theft, or damage of personal belongings at any time during the retreat. If a participant causes damage to property, furnishings, or equipment at a retreat venue, they will be held financially responsible and must reimburse the property owner directly for the cost of repairs or replacements.

9. Media and Photography
By attending a retreat or event, you consent to being photographed or filmed for marketing, website, promotional, or social media purposes by Becoming Retreats and Jessica Mackenzie. If you prefer not to appear in photographs or videos, you must notify the organiser in writing prior to the start of the retreat.

10. Governing Law
This Agreement and all matters arising from it shall be governed by and construed in accordance with the laws of Scotland, and the courts of Scotland shall have exclusive jurisdiction.

health & safety LIABILITY WAIVER

Before participating in this or any other exercise programme, individuals should consult with a physician.
I, the undersigned, acknowledge that I am 16 years of age or over and have voluntarily chosen and requested to participate in the retreat, class, private session, workshop, event, or activity with Becoming Retreats and the yoga teacher Jessica Mackenzie, as well as any other facilitator assisting or leading a class, private session, workshop, event, or activity at Becoming Retreats.

Acknowledgement
I am aware that participation in the retreats, classes, private sessions, workshops, events, or activities may be hazardous. I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility is required. I represent that I possess the level of health, strength, fitness, and flexibility necessary to participate safely in these activities.
I am voluntarily participating in these activities with full knowledge of the risks of injury and assume all responsibility and liability for any and all injuries or health issues I may sustain as a result of my participation.

Release
In consideration for being permitted to participate in the classes, private sessions, workshops, events, or activities, I agree that I, my heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of any of the hosts, instructors, organisers, or participants in the retreats, classes, private sessions, workshops, events, or activities, including but not limited to Becoming Retreats, for injury or damage resulting from my participation in such activities.
I release all such hosts, instructors, organisers, and participants, their agents, and heirs from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or may hereafter have for any injury, illness, loss of life, or damage to property associated with my participation.

I have carefully read this agreement and fully understand its contents. I am aware and agree that it constitutes a complete release of liability for any injuries or damages I may sustain during or as a result of retreats, classes, private sessions, workshops, events, and activities with Becoming Retreats and all associated hosts, instructors, organisers, and participants.

Activities on Retreats and Events
I understand that retreats and events with Becoming Retreats may include activities such as, but not limited to:
Swimming in the sea, swimming pool, or open water
Being on a boat
Cold water immersion
Surfing or paddleboarding
Long walks or hikes, including in hot weather
Breath retention or holding the breath for extended periods during classes
I acknowledge that participation in these activities carries inherent risks, including but not limited to slips, falls, drowning, sun exposure, dehydration, physical exertion, and environmental hazards. I voluntarily choose to participate in these activities, assuming full responsibility for my safety and wellbeing, and release Becoming Retreats, its organisers, instructors, and facilitators from any liability arising from participation in such activities.

Pregnancy Waiver (if relevant)
In addition to the above release, I agree that if I currently am or become pregnant, I release and hold harmless Becoming Retreats, and their supporting instructors, volunteers, childcare workers, and all other persons or entities acting on their behalf, from any and all claims, demands, suits, costs, and charges in connection with or arising out of services offered by Becoming Retreats, including but not limited to personal injury, bodily harm, or property damage.
I acknowledge that Becoming Retreats and its supporting instructors, volunteers, childcare workers, and representatives are not trained pregnancy or antenatal professionals, and attendance at non-pregnancy-specific classes is not recommended. I confirm that I have consulted with a medical professional who has advised that attending heated or non-heated, non-pregnancy classes is safe and appropriate for me.

By purchasing, booking, or signing up to a Becoming Retreats retreat or event, I acknowledge that I have read, understood, and agree to the following Health and Safety Liability Waiver and Terms & Conditions, and that my booking and participation constitute full acceptance of all terms set out herein.

Terms and conditions 

Yoga Teacher Training

By purchasing from Becoming Retreats you agree to all of the terms and conditions stated below.

By proceeding to purchase any of the BECOMING RETREATS retreats, yoga teacher trainings, classes, or any service(s), you (the “participant”) acknowledge and agree to be bound by the following Terms and Conditions. The Terms and Conditions may be updated at any time, after providing notice to you. The participant agrees to be bound by any future amendments made to the Terms and Conditions. The participant can review the most current version of the Terms and conditions at any time by accessing the “Terms and Conditions” link on the BECOMING RETREATS website.

Referred to herein as “Participant”. Jointly referred to as “parties” or individually as “party.” WHEREAS, BECOMING RETREATS offers yoga teacher trainings and Participant wishes to purchase such yoga teacher training.

NOW, THEREFORE, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

1. SERVICES. BECOMING RETREATS shall provide Participant with accommodations in the Yoga Teacher Training (“the Training”). During the Training, BECOMING RETREATS will provide Participants the yoga teacher training tuition, room (personal or shared), all meals listed, and all other activities listed within the training guidelines.

2. TERM. The term of this agreement commences upon purchasing the Training and expires at the end of the final day of the Training, unless terminated earlier by either party.

3. PAYMENT. The total cost of the Training must be paid in full prior to the Training as set forth below. Failure to make the payments as set forth below will result in automatic breach of this Agreement by Participant and all payments made by Participant will be forfeited by Participant.

a. Non-Refundable Holding Fee (£50) is required upon execution of this Agreement. This fee will be credited towards the total non-refundable deposit upon submission of the Training application and payment of the remaining deposit within 48 hours. Failure to submit the application within the specified timeframe will result in forfeiture of the holding fee, and the reserved space will be reopened for booking.

b. Non-Refundable Deposit (equivalent to one-sixth of the total cost), excluding the holding fee, must be remitted within 48 hours of receiving the invoice. This deposit serves to secure your reservation for the Training and is non-refundable.

c. The remaining balance is to be settled 60 days prior to the commencement of the Training. Failure to make the full payment within the stipulated timeframe will result in automatic cancellation of the Participant's space, with no refunds issued.

4. CANCELLATIONS. BECOMING RETREATS reserves the right to make any changes deemed necessary, including Training cancellation as per BECOMING RETREATS Terms and Conditions. All requests for cancellation by Participant must be submitted in writing, via email at the following email address: booking@becomingretreats.com

a. The Participant shall forfeit the entire Non-Refundable Deposit (calculated as one-sixth of the total cost stated during the booking, excluding the holding fee) and Administration Fee of £200 upon cancellation of this Agreement regardless of the time of cancellation or the reason for the cancellation. There will be no exceptions, including, but not limited to, travel restrictions, quarantines, medical emergencies, lock downs, weather restrictions, illnesses, Covid-19, travel changes, border closings. The Non-Refundable Deposit, holding fee and Administration Fee are non-transferable and cannot be applied to a different Training.

b. Cancellation Notice Received up to and including 61 Days Prior to Start Date of Training: In the event that the Participant cancels this Agreement up to and including 61 days prior to the start date of the Training, Payments are eligible (but not guaranteed) for refunds, with the exception of the all nonrefundable deposits, non-refundable holding fee, plus £200 administrative fee.

c. Cancellation Notice Received Less than 60 Days Prior to Start Date of Training. Participant will not be entitled to any refunds whatsoever if Participant cancels this Agreement less than 60 days prior to the start date of the Training.

5. COVID-19 DELIVERABLES BY PARTICIPANT. IF the Participant has symptoms of COVID-19: Participant shall provide a negative Covid-19 test within 48-72 hours from the Training start date from the country where the Training is being held, even after the Participant’s flight in, if traveling from another country. Participant will be banned from joining and participating in the Training without proof of a negative Covid-19 test. Failure to provide such negative testing results will result in forfeiture of all payments made by Participant. The COVID-19 test can be done by either PCR, ANTIGEN or at home LATERAL FLOW kits.

6. THIRD PARTY VENDORS. Third party vendors may be contracted to provide lodging, transportation, catering, meals, and/or other services. Participant understands and acknowledges BECOMING RETREATS is not responsible for the actions or negligence of such third party vendors. Any claim Participant may have against third party vendors shall be initiated against the third party and not BECOMING RETREATS.

7. SEVERABILITY. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision.

8. NO WAIVER. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred.

9. GOVERNING LAW. All terms of these Terms and Agreements shall be governed by, construed, and enforced in accordance with the laws of Scotland, without regard to conflicts of laws provisions. The parties hereby submit to the sole and exclusive jurisdiction of Scotland in any action, suit or proceeding arising out of or relating to BECOMING RETREATS.

10. DAMAGE TO PROPERTY. In the event that the participant damages the property and/or the possessions and items within the property, the participant must pay for the damage costs. BECOMING RETREATS is not responsible for the damage made to or within the property by such participant and therefore will not pay for the damage. The participant must pay damage costs to the property owner directly.

11. LATE PAYMENT INSTALMENTS. Participants opting for monthly payment plans are required to ensure timely payment of each instalment. In the event of a missed payment, a grace period of 5 days will be granted. However, should the payment not be received within this grace period, a late fee equivalent to 5% of the due amount will be added to the subsequent payment invoice. It is the responsibility of the participant to manage and fulfil their payment obligations promptly to avoid any additional charges.

12. RIGHT TO REFUSE SERVICE. BECOMING RETREATS reserves the right to accept, decline, or retain any person as a participant at the Training at any time without liability and without any obligation to pay a refund or any other amount whatsoever. In maintaining the purpose and objective of the Yoga Teacher Training, BECOMING RETREATS may decline Participant from taking part of the Training if Participant displays violent behavior, including, but not limited to language and/or actions. BECOMING RETREATS is not responsible or liable for any participant who leaves the Training prior to its conclusion or for any activity undertaken by the Participant that is not part of the Training.

13. NO WARRANTIES. BECOMING RETREATS makes no warranties or representations, stated or implied, regarding any aspect of the Training. In particular, there is no guarantee, stated or implied, regarding:

a. The number of participants or the age of participants taking the Training

b. The amount of time that Jessica Mackenzie, or other teachers or volunteers, will be personally leading the Training;

c. The time spent at any given location on the Training;

d. Photos taken and/or posted on BECOMING RETREATS website and social media channels or visiting any specific sites shown on photos on BECOMING RETREATS website and social media channels.

e. The quality of workouts, skill sessions, or other subjective experiences on the Training; or

f. Any other aspect of the Training.

14. INSURANCE. Participant is strongly advised to obtain travel, medical, accident, cancellation, and baggage insurance independently, especially if traveling from abroad. BECOMING RETREATS will not provide Participant with any insurance aforementioned and it is the sole responsibility of Participant to obtain.

15. ALLERGY DISCLAIMER. BECOMING RETREATS contracts third party vendors to provide catering and meals and room and board to Participant, as such, BECOMING RETREATS does not guarantee an allergen-free environment. Participant is aware that Participant will be exposed to food, activities, tangibles, and persons which may result in exposure to allergens and Participant acknowledges assumption of the risk. Participant shall be fully responsible for any medical costs or expenses related to allergic reactions, food sickness, food poisoning or any other related conditions.

16. ROOMS AND ACCOMMODATIONS. BECOMING RETREATS provides rooms/accommodations to Participant to provide a full experience Training. Such accommodations include villas, cottages, resorts, rooms, and others, as may be available in the locality of the Training. Such housing, lodgings, rooms, or accommodations are not owned by BECOMING RETREATS and BECOMING RETREATS is not responsible for providing security to Participants. BECOMING RETREATS is not responsible for any theft, damage, injury, loss, acts of terrorism, or the like, to Participant. Moreover, Participant expressly waives any right (whether in contract, tort, or both), to hold BECOMING RETREATS liable for any of the aforementioned acts. Participant shall exercise ordinary care in safeguarding any personal belongings or possessions. Participant acknowledges Participant is entirely responsible for his/her personal safety, health, and well-being during the Training.

17. PERSONAL EXPENSES. Participant shall be responsible for personal excursions, personal expenses, souvenirs, and anything else which is not expressly included in the Training by BECOMING RETREATS.

18. CANCELLATION DUE TO TRAVEL CONDITIONS. BECOMING RETREATS is not responsible or liable for any cancellations due to weather or travel conditions, including, but not limited to the following:

a. Any changes or delays in air schedules, missed airline or other carrier connections, or other services, local transportation, missed flights, missed or cancelled buses or trains, cancelled flights;

b. Injury, loss, illness or damage to persons or property, including luggage and sponsored gift items;

c. Additional expenses resulting from changes in exchange rates, tariffs, visas, vaccinations or schedule change;

d. Defect in any vehicle or the act or default of any company or person engaged in conveying the Training Participants, or in carrying out the arrangements of the Training, or otherwise;

e. Additional expenses incurred or due to including but not limited to: sudden sickness, weather conditions, strikes, or other causes or acts of God; or losses due to cancellations.

19. PUBLICATION RELEASE. Participant may be photographed, audio-recorded and/or video-recorded during the Training. BECOMING RETREATS reserves the right to publish any such photographs, audio recordings, and video recordings without obtaining further consent from any participant.

Participant authorises BECOMING RETREATS to use such recordings or images by BECOMING RETREATS in the course of business, for any lawful purpose, including for use on BECOMING RETREATS website, social media channels, marketing materials, media publications, online and print advertising. Including but not limited to; website www.jessmackenzie.yoga and www.becomingretreats.com AND social media channels @_jessyoga and @becomingretreats. Participant releases BECOMING RETREATS and its representatives from any liability in connection with any such use of such photographs, audio recordings, and video recordings.

20. NO MEDICAL TREATMENT. Participant understands and acknowledges that the Training is in no way psychotherapeutic or medical in nature. The Training is not involved with the treatment of disease, illness, or condition of any kind and does not, in any way, substitute for medical diagnosis or treatment. BECOMING RETREATS does not, or any of its volunteers, agents, assigns, officers, or employees treat, prescribe, or diagnose any illness, disease, condition, or any other physical or mental disorder. Any personal advice or answers provided during the Training are for entertainment purposes only.

OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES.

PARTICIPANT FURTHER HEREBY AGREES TO INDEMNIFY AND HOLD BECOMING RETREATS, ITS OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES HARMLESS FROM ANY LOSS, DAMAGE, JUDGMENT, LIABILITY OR EXPENSE (INCLUDING LEGAL FEES) SUFFERED BY OR RENDERED AGAINST BECOMING RETREATS ON ACCOUNT OF ANYTHING ARISING OUT OF THIS AGREEMENT.

PARTICIPANT UNDERSTANDS AND ACKNOWLEDGES THERE ARE INHERENT RISKS IN PHYSICAL TRAINING, INCLUDING YOGA EXERCISE ACTIVITIES. PARTICIPANT SHALL CONSULT WITH A PHYSICIAN PRIOR TO PARTICIPATING IN THE TRAINING AND OBTAIN PRIOR APPROVAL TO PARTICIPATE. PARTICIPANT RELEASES BECOMING RETREATS FOR ANY MEDICAL EXPENSES, MEDICAL CARE, MEDICAL NEEDS FOR ANY INJURY PRIOR, DURING OR AFTER THE TRAINING. THIS INCLUDES MEDICAL EXPENSES, MEDICAL CARE, MEDICAL NEEDS OR DAMAGE FOR ANY COVID-19 RELATED EXPENSES.

PARTICIPANT IS ENTIRELY RESPONSIBLE FOR ITS OWN PERSONAL SAFETY, HEALTH, AND MENTAL, PHYSICAL, EMOTIONAL, AND GENERAL WELL-BEING BEFORE, DURING, AND AFTER THE TRAINING. PARTICIPANT HEREBY RELEASES BECOMING RETREATS, ITS OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES OF ANY LIABILITY FOR ANY INJURIES OR DAMAGES MENTALLY OR PHYSICALLY THAT PARTICIPANT, OR PARTICIPANT’LS FAMILY MEMBERS, MIGHT SUFFER DURING OR AFTER THE TRAINING.

I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility will be required. I represent that I possess the level of health, strength, fitness, and flexibility necessary to participate in these activities. I am voluntarily participating in these activities with knowledge of the risks of injury. I assume all responsibility and liability for any and all injuries I may sustain due to my participation in these activities. 
Release 
In consideration for being permitted to participate in the classes, privates, workshops, events, or activities, I agree that I, my heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of, any of the hosts, instructors, organisers, or participants in the classes, privates, workshops, events, or activities including but not limited to Becoming Retreats, for injury or damage resulting from my participation in such classes, privates, workshops, events, or activities. I release all such hosts, instructors, organisers, and participants, their agents and heirs, from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter may have for any and all injury, illness, loss of life, loss of or damage to property associated with my participation in the classes, privates, workshops, events, or activities. I have carefully read this agreement and fully understand its contents. I am aware and agree that it is a complete release of liability for any injuries or damages I may sustain due to classes, privates, workshops, events, and activities with Becoming Retreats and all such hosts, instructors, organisers, and participants. 
Pregnancy Waiver (if relevant) 
In addition to the above Release, I agree now and in the future if I become pregnant that by signing this Liability, I release and hold harmless Becoming Retreats, and their supporting instructors, volunteers, childcare workers, and all other persons or entities acting for her, from any and all claims, demands, suits, cost and charges, in connection with or arising out of services offered by Becoming Retreats, including but not limited to, personal injury, bodily harm, injury, and/or property damage. I agree I have been advised that Becoming Retreats and supporting instructors, volunteers, childcare workers and all other persons or entities acting for her are not trained pregnancy or antenatal professionals, and attendance to non-pregnancy specific classes is not recommended.
